THE SOFA CLUB TERMS AND CONDITIONS

These Terms & Conditions govern your purchase of goods from The Sofa Club. By placing an order, you accept these Terms & Conditions in full.


1. ASSEMBLY INSTRUCTIONS

  • Do not open boxes with a knife.

  • Use a drill only to tighten bolts and screws lightly. Use a hand spanner or screwdriver for adjustments.

  • We do not take or remove any rubbish. It is the customerโ€™s responsibility to dispose of packaging, wrappings, and debris.

  • We strongly advise customers to use our courier delivery services. If you elect to pick up bulky items, any damages are deemed to be handled by you (the customer) and will not be covered under any warranty.


2. CONDITIONS OF SALE

  • Please choose carefully. The Sofa Club is not responsible if you make a wrong decision or change your mind. Under no circumstances will we refund for change-of-mind purchases.

  • If you wish to claim under warranty, you must pay all transport costs to return the goods to our warehouse for assessment.

  • We cannot be held responsible for delays in custom-made orders, or furniture delayed due to overseas manufacturers or suppliers.


3. LAYBYS

  • A deposit of 40% of the purchase price is required to begin a layby.

  • Fortnightly payments are required thereafter.

  • Laybys must be completed within 8 weeks of purchase.

  • Laybys exceeding 8 weeks will incur a $10/week storage fee.

  • Cancellation of a layby will incur a 30% cancellation fee of the total amount purchased.


4. CONDITIONS OF DELIVERY

  • Delivery is to your front door only. Couriers are not obliged to deliver upstairs or carry goods into your home.

  • All deliveries do not include assembly or removal of packaging.

  • The Sofa Club accepts no responsibility for any breakages inside or outside your home once the goods are delivered.

  • Customers must ensure that breakable items are removed and accessways are clear for delivery.

  • It is essential that the customer measures doors, hallways, and the space where furniture is to be placed before delivery to ensure the furniture will fit.

  • Cancellation of delivery must be notified at least 48 hours before scheduled delivery; otherwise, a $100 cancellation fee applies.


5. SOFA WARRANTY

  • Warranty covers:

    • Fabric, leather, foam, stitching and frame for 1 year.

  • Leather may naturally crease, fade, or change colour over time due to normal use. These changes are not defects.

  • Natural creases, wear and tear are expected and are not covered by warranty.

  • Claims due to cuts, burns, tears, fading, mistreatment, or negligence are not covered.

  • For all woven or fabric sofas: lint balls or piling are natural occurrences and not covered under warranty. You are encouraged to use electric or hand devices to remove piling/lint balls.

  • Regular maintenance is strongly advised. Clean armrests, seats, & headrests every 3โ€“5 months using suitable products (for example, The Sofa Clubโ€™s Ultimate Sofa Care or equivalent).


6. CUSTOMER PICK UP

  • All furniture picked up from our warehouse or retail store is deemed brand new. We have opened, quality-checked, and ensured no damage before pickup.

  • The Sofa Club is not responsible for any damage that occurs once the furniture leaves our warehouse.

  • Please consider weather and transport conditions when collecting.

  • Although pickup is available, we highly recommend using our couriers for safe delivery of your furniture.


7. LIMITATION OF LIABILITY & DISCLAIMER

  • To the fullest extent permitted by law, The Sofa Club and its directors, officers, employees, agents, and suppliers disclaim any liability for:

    • Any indirect, incidental, special, or consequential loss or damage.

    • Loss or damage arising from your failure to follow the assembly instructions.

    • Loss or damage arising from misuse, neglect, or mistreatment of the furniture.

  • These Terms & Conditions do not limit your rights under the Australian Consumer Law (ACL). If goods are faulty, not fit for purpose, or do not match their description, you may have statutory rights which cannot be excluded.


8. GOVERNING LAW

  • These Terms & Conditions are governed by and will be interpreted in accordance with the laws of Victoria, Australia.

  • Any disputes arising will be subject to the non-exclusive jurisdiction of the courts of that State.


9. CHANGES TO TERMS

  • We reserve the right to update or amend these Terms & Conditions from time to time.

  • Any changes will be effective upon posting on our website. Your continued purchase or use constitutes acceptance of the updated Terms & Conditions.
